An Alternative To Jail Time
While Illinois law outlines jail time for all DUI offenses, those found guilty of violations, especially first-time convictions, are often spared spending significant periods of time in jail. In many cases, a person who has been convicted may be put on probation for DUI.
Probation is a specific time of supervision, during which you may report to either the court or to a probation officer. The severity of your charge and the length of your probation affect whether you can expect more or less supervision while you are on probation.
During the time you are serving probation for DUI, you will probably be given other restrictions, such as abstaining from alcohol or illegal drugs, obeying all laws, going to alcohol awareness classes, community service and — if applicable — checking in with your probation officer.
Common DUI Probation Periods
If you have been convicted of an intoxicated driving offense, you are likely relieved to learn that you may be designated for probation rather than have to serve significant jail time for DUI. This form of punishment can allow you continue working and attending to family responsibilities.
DUI probation periods follow:
- For a first conviction you may face up to one year of probation.
- A second conviction can lead to a probationary period of 48 months.
- For a third conviction you may also face up to 48 months of probation.
- A fourth or subsequent conviction will not allow you to be eligible for probation.
As with jail terms, longer probationary periods may apply to cases that are viewed more severely by the courts. For example, if a first conviction involves the transportation of a child under the age of 16 or accident injuries or deaths, the one-year probationary period for a standard DUI violation may be extended to 30 months.
It is important to remember that if you violate or fail to meet the conditions of your DUI probation, it can be revoked and the full jail sentence applicable to your charge may be imposed.
